EXCEPTIONS TO THE RIGHT TO WITHDRAW 

The right to withdraw does not apply to the delivery of:

  • Products that may not be returned for reasons of hygiene or health protection if they have been opened after delivery (for example cosmetics), or that, after delivery, were inseparably mixed with other products;
  • Pre-sealed sound or video recordings or sealed software if the seal has been broken after delivery;
  • Goods made according to your specifications or clearly customised;
  • Products that could quickly deteriorate or expire, for example food or perishable products, or any having an expiry date;
  • A service, providing that it has already been rendered and you had accepted that it would be provided at the time of ordering it;
  • Digital content (including apps, digital software, e-books, MP3, etc.) that has not been delivered in physical format (i.e. not contained on media such as CD or DVD) if you had consented to its execution at the time of delivery, meaning you cannot withdraw from that moment;
  • Daily press, regular publications or magazines with the exception of subscription contracts; and
  • Alcoholic drinks whose price had been established when you placed the order, that cannot be delivered within 30 days, and whose actual value depends on market fluctuations beyond our control.

OUR VOLUNTARY RETURNS GUARANTEE 

Notwithstanding your legal rights, Starlite Shop makes the following Voluntary Returns Guarantee: All products on the Starlite Shop web site can be returned within 14 calendar days from when they were received, providing that they are complete, unused and undamaged. For multimedia products sealed in plastic and/or with sealed packaging, for example, CDs, audio cassettes, VHS videos, DVDs, Blu-Ray, PC, video-games and software), this means we will only accept their return if the packaging has not been removed or if the seal has not been damaged. The products will have to be returned through our Returns Centre. This Voluntary Returns Guarantee does not apply to digital products or software that are not received in a physical medium (i.e., not contained in media such as CD or DVD).
If you return the products under this Voluntary Returns Guarantee, we will refund the price of the product you paid, but not the shipping costs of your original purchase. You will have to assume the risks and charges of the return transport. This guarantee of return does not affect your legal rights and therefore does not affect your right of withdrawal as mentioned above.

LEGAL GUARANTEE OF CONFORMITY

Customers in the European Union (except United Kingdom) shall have a two year after-sales warranty as from the product delivery date for the repair or replacement of products purchased in Starlite Shop if they were defective or did not match the offer advertised. You can request a refund or reduction in the price of the product if the product has not been repaired or replaced within a reasonable period of time, without any great difficulties for you.
In the case of second-hand products (reconditioned), the warranty period may be less than two years.

Prices and availability

On the web site we include information on the availability of the products we sell, giving details on the information page for each product. It is not possible to give more accurate information on the availability of a product beyond what is shown on the product information page or in other places on the web site. Bear in mind that the estimated shipping times are merely estimates. They are not guaranteed delivery times and therefore cannot be taken as certain. When we process your order, we will inform you by email in case any of the products included in your order is not available.
Payment for purchases is made by bank card. The purchase price will be charged at the time of shipping the order.
If the POS (Point of Sale) terminal informs that the card has been rejected, the order will be automatically cancelled, informing the customer online of the cancellation. 

Customs Information

When you place an order for products from Starlite Shop for delivery abroad, they may be subject to import duties and taxes, which will be charged when the package reaches its destination. Any additional costs due to customs duty will be for your account. We have no control over these costs and cannot predict how much they will be. Customs policies vary considerably from one country to another. To obtain information on the duties applicable to your country, consult the pertinent customs office. Remember also that when you place an order with Starlite Shop, the law formally considers you to be an importer, and therefore you have to comply with all laws and regulations applicable in the country where you are receiving the merchandise. Your privacy is of great importance to us, and we are aware of how important it is for you the way the information relative to your order is processed and shared. We want our international customers and anyone having products shipped internationally to know that international shipments are subject to inspection and to being opened by the customs authorities.

General Conditions relating to your use of Starlite Shop and to buying products 

Minors 

Minors are not permitted to buy products in Starlite Shop. The children’s products that we sell must be purchased by adults. Children under the age of 18 may only use Starlite Shop under the supervision of a parent or guardian.

Other business 

Apart from Starlite Shop and its affiliated companies, other parties can operate shops, offer services or sell product lines on the web site. We provide links to web sites of companies in their group and to other businesses. We are not responsible for reviewing or qualifying, or for guaranteeing or backing the offers of any of these companies or individuals, nor the content hosted on their web sites. Starlite Shop takes no responsibility whatsoever for the actions, products and content of any of these (or other) third parties. You will always know if a third party is involved in your transactions. Starlite Shop may share any customer information relative to the transaction with that third party. We recommend you to carefully read the declarations of privacy and conditions of use of those third parties. 

Electronic Communication

Whenever you enter the Starlite Shop Web Site or you send us an email, you will be communicating with us electronically. We will contact you by email or by publishing notices on our web site. For contractual purposes, you are consenting to receive communications from us through electronic media, and you understand that all contracts, notices and other notifications that we send you electronically fulfil the same legal requirements as if those communications had been sent in writing. This does not affect your legal rights. 

Loss 

Starlite Shop will be responsible for any losses you sustain as a result of our failure to comply with these General Terms and Conditions if that loss was reasonably foreseeable by both parties when you started using the web site, or when the corresponding sales contract for goods was entered into between both parties. To the extent permitted by applicable legislation, we shall not be held liable for any business losses (including loss of earnings, profits, contracts, anticipated savings, data, gains or unnecessary expenses) nor for any other indirect or consequential lossthat is not reasonably foreseeable by both parties when you began using the web site, or when the corresponding sales contract for goods was entered into between both parties. We do not establish any limitation to our legal liability for death or personal injury caused by negligence or non-compliance on our part, or caused by gross negligence or wilful intent on our part. 

Modification of the Service or Variation of the Conditions 

We reserve the right to make changes to our web site, our policies, and to these General Terms and Conditions at any time. You will be subject to the policies, Specific Conditions and General Terms and Conditions in force when you are using the web site or when you place an order, unless by law or by requirement from any public authorities, changes have to be made to those policies, the Specific Conditions applicable and these General Terms and Conditions (in which case, they may have to be applied to any orders that you had made previously). If any of these General Terms and Conditions is invalidated, ineffective or inapplicable for any reason, that condition shall be excluded and shall not affect the validity or applicability of the other conditions. 

Events beyond our reasonable control 

We shall not be liable for any delay or non-fulfilment of our obligations under these conditions if this is due to events that are beyond our reasonable control. This does not affect your legal rights. 

Waiver

In the case of your non-fulfilment of these General Terms and Conditions, we may exercise our rights and legal recourses in any other situation in which you have failed to fulfil these General Terms and Conditions, even if we take no action in that respect at the time. 

Applicable law and jurisdiction 

These conditions shall be governed by and construed under Spanish law. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. Both parties agree to submit to the non-exclusive jurisdiction of the district courts of the city of Madrid.
